Dr. Ashwani Kumar is one of India's most distinguished legal professionals, whose career spans over four decades of advocacy. A designated Senior Advocate of the Supreme Court of India, he has earned widespread recognition for his intellectual rigor, advocacy before constitutional courts, and enduring contributions to the development of public law and constitutional governance in India.
After graduating with a Bachelor's degree in History (Honours) from St. Stephen's College, University of Delhi, Dr. Kumar obtained his LL.B. from the Faculty of Law, University of Delhi, and later completed his M.Phil. from Jawaharlal Nehru University. His academic pursuit of legal excellence culminated in the award of a Doctorate in Law, reflecting his lifelong commitment to constitutional thought.
In 1986, Dr. Kumar was designated as a Senior Advocate at the remarkably young age of thirty four, becoming one of the youngest advocates in the country to receive this distinction. The designation recognized his exceptional legal acumen, courtroom advocacy, and standing at the Bar. Throughout his professional career, he has appeared in numerous matters involving constitutional law, administrative law, civil and commercial disputes, public policy, and questions of significant public importance before the Supreme Court of India and other constitutional courts.
His professional excellence led to his appointment as the Additional Solicitor General of India in 1991. In this capacity, he represented the Union of India in significant constitutional, statutory, and policy related litigation before the Supreme Court and various High Courts. His tenure was marked by his balanced advocacy, nuanced understanding of constitutional principles, and commitment to the rule of law.
Following his tenure as Additional Solicitor General, Dr. Kumar continued to maintain an active and distinguished practice as a Senior Advocate before the Supreme Court of India. His practice has encompassed constitutional litigation, public law disputes, arbitration, commercial matters, and issues involving governmental and regulatory frameworks. He has been widely respected for combining meticulous legal analysis with a statesman-like understanding of constitutional institutions and democratic governance.
Dr. Kumar is a crusader for human rights and has taken up several causes including the enactment of a comprehensive Anti-custodial torture legislation for India, the issue of the right of the elderly to live with dignity and the human rights of Rohingyas. He has espoused the cause of liberty of human rights activists, apart from appearing before the Supreme Court to oppose pre-natal sex detection tests to prevent female feticides.
Dr. Kumar's legal career has been complemented by an equally distinguished contribution to legal education. He has served as a Visiting Distinguished Fellow at Trinity College Dublin and as a Visiting Professor at the National Law School of India University, Bengaluru. He has delivered lectures at leading international academic institutions, including Oxford Human Rights Hub, King's College London, the University of Birmingham, and The Fletcher School of Law and Diplomacy, engaging with contemporary questions of constitutionalism, democracy, human rights, and international law.
